The gullible employee (cripple duped)

This former employee (we shall call Gullible) of Pacific Testing Services had been the only employee permanently in PNG & was unfortunately crippled in a horrendous car accident a few months before the ‘lost isotopes incident’. He was then himself a victim of these ruthless employers

At that time, he had been owed nearly a year’s wages (for work done up to July 1999). A sucker for the glib ‘cash flow problems’ line his employers had been feeding him – Gullible had even used thousands of dollars from his own account to pay for company bills such as the rent on the apartment/office, telephone & electricity, & petrol. Still available are the receipts for company car insurance, company phone & electricity bills that can be matched with this employee’s bank statements from that time

After the accident, Gullible was medevac’d to Cairns. One of the directors, Fabian Lyons, had even visited him in hospital shortly after his accident & assured him his money would be forthcoming

But 2½ years down the track (possibly distracted by ongoing pain, operations, & threat of amputation), this employee had still not persuaded his employers to pay him, or even acknowledge their intention to do so in writing

It seemed these company directors had been running out the clock on the time limit (statute of limitations period) to lodge a legal wage recovery action

Sorry to rub it in (we refer now, to the unfortunate employee), but while he was recuperating, from July 1999 to 2002, & being fed lines by Fabian Lyons of poor business, cash flow problems, & other crap, these directors had up to 8 people working for them in PNG at that time – far from being broke they must have been making a lot of money

Names of these 8 ‘secret’ workers that were working for Peter Nelson & Fabian Lyons at this time have been found among documents in the discarded filing cabinet, i.e., from contacts list & timesheets. They include Chris, Kim, Neil, Ian, Damien, Dean, Carl, & finally Warren. Warren must have been really fed-up judging by his fax on 10th March that year when he withdraws his services quoting severe tardiness & inaction by management. Warren also appears extremely concerned about his remuneration for services & the company’s signatory status (authorisation to sign NATA reports)

We won’t reveal any more about these ‘secret 8’ for now unless any of these people wish to add something

Eventually Gullible enlisted the help of a solicitor to remind his employers of their responsibilities. Upon receiving this communication one director telephoned the solicitor & promised to reply with an offer in writing – but instead, within a week had de-registered the company that had operated in PNG for whom the, now crippled, employee had been engaged. No written reply was ever received. Both Peter Nelson & Fabian Lyons continued with their respective Queensland businesses; & probably still engaged in activities in PNG – sending their workers over on business’ visas as they usually did

We cannot legally say these men stole from a cripple as they didn’t – their company did. The company they de-registered a week or so after Gullible had engaged a lawyer to ask for his money, money that he had earned & was rightfully his

Gullible paid for legal services for several months & never received a single reply from Peter Nelson or Fabian Lyons, apparently it was a ‘legal grey area’ as the incident had occurred in PNG even though the victim & the perpetrators were Australians. Eventually the legal cost became too expensive

It seems that justice really is only for those who can afford it !

Many years have gone by & Gullible still wears metal leg braces on his leg, & still relies on prescription medications to control the pain – both physical & mental – that resulted from the accident & the subsequent betrayal by people he had supported & helped so much

Despite a year of loyal (unpaid) employment, covering their company’s working indiscretions, & paying their ongoing bills, Gullible was well & truly suckered
